About You

We are seeking a General Counsel to join our rapidly growing team! In this role, you will be responsible for evaluating and validating product claims for Nutrafol products (supplements and topical cosmetics), including claims-related launch responsibilities for domestic and international markets, reviewing all vendor/internal contract agreements, IP, trademark and copyright submissions, and advising business to ensure legal compliance for current and future business process, structures, and policies. Primary stakeholders will include the product development team, science team, and external legal consultants or agencies.

Responsibilities

Act as Principal contact person in the claims review and make recommendations to modify and strengthen existing claims.
Perform legal and compliance review of advertising copy in all forms of media including but not limited to, television, digital media, packaging, print, public relations and other promotional materials.
Review test reports, clinical studies, test designs and literature to determine if sufficient for claims support.
Create claims dossiers and provide substantiation dossiers to authorities in the US and abroad as needed, includes attestations, television network substantiations and retailer substantiation requests.
Apply and provide claims advice applying laws, regulations and guidance from Federal Trade Commission, Food & Drug Administration and National Advertising Division of the Better Business Bureau, case law and assists with defending challenges (litigation).
Be knowledgeable about and anticipate legislative and regulatory changes affecting the company, especially on industry-specific issues, corporate governance and regulatory affairs.
Lead Intellectual Property submissions to IP Lawyers or US Patent Office.
Collaborate with international colleagues on claims/communications limitations in countries where products will be sold. Maintain regulatory standards and protocols to ensure compliance with international regulations.
Review raw material and ingredient compositions for regulatory conformity based on industry guidelines / international restrictions.
Prepare and submit regulatory notifications and registrations as required to ensure compliance and timely approval for market release of new and existing products.
Create and review INCI’s for artwork
Review and update Terms and Conditions Policy, Subscription Policy, and any additional eCommerce policies.
Keep management informed of legal concerns and advise on best course of action.
Assist management with formulating and implementing policy and developing and updating legal documents such as NDA.

Requirements

Law degree required including good standing with the New York State Bar.
10+ years experience in corporate law (pharmaceutical and cosmetics/personal care preferred), including experience in regulatory and claims substantiation, necessary.
Extensive knowledge of the product claims regulations and U.S. compliance landscape.
Strong communication skills (oral, written, and interpersonal) and the ability to identify and recommend solutions to problems.
Strong negotiation skills.
